In the past, the Florida courts would generally award primary custody to one parent, and the other parent would get visitation times (every other weekend, for example). In recent years, however, courts are becoming much more open to more creative approaches that allow the child equal time with each parent.
Another change in recent years is the emphasis by the courts on divorcing parties solving many of their divorce-related issues outside of the courtroom. Because the court is so overloaded, divorcing couples are encouraged to make their own parenting plans without having to litigate the issue. This allows the court to simply look over a parenting plan proposal and make sure it is equitable, rather than refereeing the entire lawsuit. From a relational standpoint, such a collaborative process many times allows the parents and children to have a healthier long-term outcome.
